When divorce involves children and significant property — matrimonial home, shared investments, business interests, inherited assets — the proceedings become substantially more complex. Multiple legal fronts open simultaneously: the divorce petition itself, interim maintenance applications, child custody and visitation arrangements, and property protection orders. Effective representation in these cases requires coordinated strategy across all these issues, not piecemeal handling.

Property in Divorce — What Indian Law Provides
- Hindu law: no automatic 50/50 property split on divorce — property belongs to whoever owns it
- Matrimonial home: the wife has a right of residence in the matrimonial home under the Domestic Violence Act
- Stridhan (wife's own property, gifts, jewellery) belongs to the wife — recovery of stridhan can be sought
- Property purchased jointly: both parties have ownership rights proportional to contribution
- Husband cannot transfer or sell matrimonial property without court permission if divorce proceedings are ongoing — injunction can be sought
- Permanent alimony (Section 25 HMA) — court can award permanent alimony considering the financial position of both parties
- Courts also consider standard of living established during marriage when fixing maintenance and alimony
Child Custody in Divorce Proceedings
- Welfare of the child is the paramount consideration — not the rights or demands of either parent
- Physical custody (who the child lives with) vs legal custody (who makes decisions for the child)
- Courts generally prefer joint custody arrangements that maintain the child's relationship with both parents
- Young children (especially below 5 years) are typically placed with the mother — unless compelling reasons exist otherwise
- Visitation rights are almost always granted to the non-custodial parent
- Child's own preference is considered for older children — particularly above 9–10 years
- Urgent custody applications can be filed during pending divorce proceedings — court can grant interim custody

Maintenance — During and After Divorce
- Interim maintenance (Section 24 HMA): maintenance awarded during the pendency of divorce proceedings
- Child maintenance: separate application possible under Section 125 CrPC or directly within the divorce petition
- Amount of maintenance: courts consider the husband's income, wife's income, standard of living, and needs of children
- Maintenance is adjustable: if circumstances change (income increase/decrease), application for modification can be filed
- Non-payment of maintenance is contempt of court — enforcement mechanisms are available
- Permanent alimony (Section 25 HMA): one-time or periodic payment fixed in the final divorce decree
Protecting Property During Divorce Proceedings
- Injunction application: court can be asked to restrain the other party from transferring matrimonial property
- Attachment before judgment: in exceptional cases, property can be attached to prevent dissipation
- NRI or out-of-state property: more complex but not outside court jurisdiction — requires careful drafting
- Joint bank accounts: court can freeze or monitor; interim maintenance comes from these
- Business interests: if a spouse has a business, its value and income are relevant to maintenance calculations
- Early action is critical — approach the court before property is transferred, not after
