If Someone Has Been Arrested — Immediate Steps
- Step 1 — Confirm which police station is holding the arrested person and the FIR number
- Step 2 — Call a criminal lawyer immediately — do not wait for morning or the next day
- Step 3 — Gather FIR details: offence sections, complainant name, and incident date
- Step 4 — Do not let the arrested person make any statements to police before the lawyer arrives
- Step 5 — Request a copy of the arrest memo — police are legally required to provide it
- Step 6 — Lawyer will assess bail type (Section 437/439 CrPC) and file urgently
- Step 7 — Ensure surety is arranged — bail granted without a surety ready delays release
If an FIR Has Been Filed — Before Arrest Happens
- Step 1 — Confirm the FIR details: police station, sections, accused names

Rights During Arrest and Custody — Know These
- Right to be informed of the grounds of arrest immediately
- Right to a lawyer of your choice — police cannot deny this
- Right to inform a family member or relative of the arrest
- Right to be produced before a magistrate within 24 hours of arrest
- Right to a medical examination if you allege custodial abuse
- Right not to be held in police custody for more than 24 hours without magistrate remand
- Remand cannot exceed 15 days at a time (police remand) — and total judicial custody has BNSS limits

- Do NOT give a statement to police without your lawyer present
- Do NOT post anything on social media about the case
- Do NOT destroy any documents, messages, or evidence — even those you think look bad
- Do NOT leave the country without informing your lawyer
- Do NOT ignore a Section 41A notice — non-compliance leads to arrest
- Do NOT pay any unofficial "police settlement" amounts — these do not protect you legally
