One of the most common — and most anxious — questions from families of accused persons is: how long will bail take? The answer depends on the type of bail application, the offence, and how the matter is handled at each stage. This guide breaks down the realistic timeline for bail at Allahabad High Court — from the moment of first contact with a lawyer through to actual release from custody — including what each stage involves and what commonly causes delays.

Stage 1 — First Contact to Filing (Day 1)
- Call/WhatsApp consultation: case facts assessed, bail type identified (Section 437, 438, or 439)
- Document checklist sent: FIR, arrest memo, remand order, accused details, surety info
- Bail application drafted: legal grounds, precedents, affidavit prepared
- Application filed at Allahabad High Court: filing index, fees, certified copies all required
- Same-day filing is possible if contact is made early in the morning and documents are ready
- Afternoon contact may result in next-morning filing in urgent cases
Stage 2 — Filing to First Listing (2–7 Working Days)
- Regular listing: 4–7 working days after filing in most bail matters
- Urgent mention: if grounds for urgency exist (serious custody conditions, health, elderly), earlier listing can be requested
- Mentioning is done by the advocate at the court — requires being present and assertive
- Vacation bench: during court vacations, urgent bail matters can be heard by the vacation bench
- NDPS and serious offence matters may be listed for a longer date if the court's NDPS bench is full

Stage 3 — First Hearing to Bail Order (1–3 Hearings)
- Regular bail (Section 439) — commonly decided in 1–2 hearings for non-complicated matters
- Anticipatory bail (Section 438) — first hearing may grant interim protection; final order at next hearing
- NDPS commercial quantity — 2–3 hearings typical; twin conditions require careful argument and response
- IPC 302 (murder) bail — may require 2–4 hearings given seriousness and prosecution response
- Government/State response — prosecution can oppose bail; court may ask for time to respond
- Counter-affidavit requirement — in some cases, court asks prosecution to file counter; this adds 1–2 weeks
Stage 4 — Bail Order to Release (1–3 Days)
- Bail order copy must be certified and sent to the relevant jail and district court
- Surety must appear with documents: identity proof, property papers (property surety) or cash
- Bail bond is executed before the relevant magistrate or court
- Jail receives the bail release order and processes release
- Typical time from order to release: 1–2 working days if surety is ready
- Delays in surety preparation are the most common cause of post-order custody extension
- Advocate Faizan Siddiqui guides the family through surety preparation to minimize delay

What Can Cause Delays — And How to Minimize Them
- Documents not ready — FIR, arrest memo, remand order all needed before filing; gather immediately
- Surety not identified — identify and brief the surety person before the bail order, not after
- Court vacations — plan around court vacation schedules; vacation bench handles only the most urgent cases
- Counter-affidavit requirement — be prepared for prosecution opposition adding a hearing or two
- Incomplete bail application — technical defects in the application cause rejection and re-filing delays
- Advocate Faizan Siddiqui minimizes all preventable delays through systematic document collection and proper filing
